These Terms of Service ("Terms") govern your access to and use of the Fitmaxxing mobile application and related services (collectively, the "App"), provided by Fitmaxxing ("we", "us", "our"). By creating an account, signing in (including via Google), or otherwise using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
Eligibility
You must be at least 16 years old (or the age of digital consent in your country) to use the App. By using the App you represent that you meet this requirement and that the information you provide is accurate.
Your account
You can create an account using your email address or by signing in with Google. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us promptly of any unauthorised use.
Subscriptions & free trial
- Fitmaxxing offers a 14-day free trial. After the trial ends, continued access to premium features requires a paid subscription.
- Subscriptions are billed and managed through the Google Play Store and renew automatically until cancelled. You can manage or cancel a subscription at any time in your Google Play account settings.
- Except where required by law, payments are non-refundable. Refunds for purchases made through Google Play are subject to Google's policies.
Acceptable use
You agree not to:
- Use the App for any unlawful purpose or in violation of these Terms.
- Reverse engineer, copy, resell, or attempt to gain unauthorised access to the App or its systems.
- Upload content that is harmful, abusive, infringing, or that you do not have the right to share.
- Interfere with or disrupt the integrity or performance of the App.
Health & fitness disclaimer
Fitmaxxing provides general fitness and nutrition information, AI-generated workout plans, and tracking tools for informational purposes only. It is not medical advice and is not a substitute for consultation with a qualified healthcare professional. Consult your doctor before beginning any exercise or nutrition program. You use the App and its recommendations at your own risk.
Your content
You retain ownership of the data and content you submit (such as workouts, meals, and progress logs). You grant us a limited licence to store and process this content solely to operate and improve the App. Our handling of your data is described in our Privacy Policy.
Intellectual property
The App, including its software, design, branding, and content (excluding your content), is owned by us or our licensors and is protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own personal, non-commercial use.
Termination
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the App. You can request deletion of your account and data via our account deletion page.
Disclaimers & limitation of liability
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the maximum extent permitted by law, we will not be liable for any indirect, incidental, or consequential damages, or any loss of data, profits, or goodwill arising from your use of the App.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
